SEC Charges Winning Kids With Securities Fraud

The investment likely seemed especially safe: stock in a company that produced children’s books.  According to Winning Kids, Inc., the company was well established, expanding nationally, and starting and acceleration phase of extraordinary growth.  According to the U.S. Securities and Exchange Commission, none of that was true.  The SEC has charged Winning Kids, its founder and CEO, Christian Haynesworth, and three sales agents, Robert Comiskey, Edward Tamimi, and Victor Selenow, with securities fraud. According to the SEC, the defendants raised approximately $2 million from approximately 200 investors nationwide, drumming up interest through radio commercials and promising investors attractive returns while failing to mention that the sales agents received commissions of up to 20 percent of the amount invested.  The SEC also alleges that Haynesworth used investor funds for personal expenses.

Notice two things about this case.  First, notice that Winning Kids advertised on the radio.  In moderating Investors Watchblog I often receive comments from investors who believe that an investment must be legitimate if it is advertised on the radio or television.  ”If it were not legitimate,” their reasoning goes, “the SEC, the FTC, or some other agency would have shut them down by now.”  That reasoning assumes that regulators have unlimited resources and immediate access to evidence.  Neither is true.  Regulatory agencies must submit evidence to courts who, appropriately, are not rubber stamps.  The agencies have to gather evidence from victims who are in denial and not inclined to cooperate, and from the defendants themselves, before they can take the case to court.  The logic also assumes that scam artists are a risk averse lot.  Nothing could be further from the truth.

Also notice that the SEC alleges that sales agents received commissions of up to 20 percent of the amount invested.  A commission that high will attract no end of salespeople willing to say anything to make the sale.

If you need your nest egg, protect it by getting a pre-investment investigation from a company experienced in recognizing cleverly disguised cons.  Thousands of senior citizens are now starting over with nothing because they failed to do so.

    Would this be the same Edward Tamimi who is a Sales Rep/Account Manager who works for Eagle Bullion Group Inc. of Jupiter FL? He has been giving me the high-pressure sales pitch to invest $5,500 of silver bullion into the Eagle Bullion Group Inc. program. I am about ready to send this 350 ounces of silver tomorrow, by Registered Mail.

    Hi, Gary:

    It would take a little investigating to determine for certain whether this is the same Edward Tamimi. I think it would be unwise to send your silver without getting the answer to that question. A BrokerSnapshot report would likely help you. Click on “Products” above, then the link for BrokerSnapshot to read more. Whether or not it is the same man, the high pressure tactics are enough reason to say “No.”

    UNFORTUNATELY, when I returned to the Eagle Bullion Group website I had read the same blog that I had posted here and “my blog” was attached to INVESTORSWATCHDOG.COM’S SLANDEROUS CAPTION aimed at Eagle Bullion Group, Inc’s very good business name and excellent character. For I had hours of research and due diligence into Eagle Bullion Group, Inc. business model and ethics…I could not find a single complaint. I am truly disappointed that Investorswatchdog.com posted my question, a simple question, on the Eagle Bullion Group website for everyone to see. I, Gary Hazen, certainly did not link my blog to Eagle Bullion Group, Inc. website…I only typed into the “Website” a “Concerned citizen”. I, normally’ am not a ‘blogger’, and this was a simple question that received a quick response. I DO HAVE TO QUESTION THE CHARACTER & INTEGRITY OF INVESTORSWATCHDOG.COM! How and why would “investorswatchdog.com” publicly display my question AND CONNECT IT TO INVESTORSWATCHDOG.COM’S SLANDEROUS HYPED HEADLINE on the Eagle Bullion Group’s website without contacting me for my permission. If you had contacted Eagle Bullion Group, Inc., this company, would have told you that this one “Edward Tamimi” DOES NOT WORK THERE. My question concerned an “individual” NOT Eagle Bullion Group, Inc. Investorswatchdog.com’s integrity is “despicable” to impugn and slander a company’s (Eagle Bullion Group) good name on their own website AND TO USE MY NAME AND BLOG AS AN UNWITTING VEHICLE SLANDER A GOOD COMPANY AND LIABLE ME TO THAT COMPANY.     I did not link your question to any other website. I answered here and only here. If it was linked to some other site, that was not my doing. I’ve re-read my answer and don’t see any mention of Eagle Bullion. I said that you should investigate further to determine whether the man charged in the Winning Kids case was the same person pitching you with high pressure tactics. As I do not have any way to either add or remove anything from the Eagle Bullion site, you should not look to me for the remedy you request. As far as an “incorrect assessment,” perhaps you can point out that assessment for me. I don’t see any assessment of Eagle Bullion at all. By the way, your email address suggests that you are sending email from eaglebullion.com. You may have an IT problem.

    Dear Pat;
    Thank you for your consideration. You have my sincerest apology for my terse and unwarranted comments (above blog). You are correct in all your assessments. The person “Edward Tamimi” was indeed the same person of “Winning Kids” and the same that did pressure sell me from Eagle Bullion Group; because of this blog he was immediately fired. As the Principals of Eagle Bullion Group failed in their vetting process, I was assured by Eagle Bullion Group that this sort of situation will be fully watched for, with full investigations of thier future Eagle Bullion employee prospects. As I was contacted by a Principal of Eagle Bullion Group on March 8, 2010 and was read this/my “blog” from the Eagle Bullion Group, Inc. website – with a seemingly ’slanderous’ heading/title that was attached to my blog and “supposedly” posted there. I was directed back to this, your ‘blog site’ while in conversation with this Eagle Bullion Group Principal, for very close to an hour conversation. I was simply “greased” by his smooth and inflamitory talk, while at this blog site. Unfortunately for you and me I was “duped”, I started to write this above blog while still in conversation with this Eagle Bullion Group, Inc. Principal. I believe my emotional and kind nature was easily noticed and ‘tapped’, taken advantage of, to cause the above “wrongful blog” to be written by me. It was at his behest that I wrote the above blog and after I finished, I went to the Eagle Bullion Group website to locate this ’said’ blog and ’slanderous headline’ and could not locate it anywhere. I wrote the “Principal” at Eagle Bullion Group, twice, to ask for “where is this “blog of mine at on Eagle Bullion’s website”…I did not receive an answer to this question. I then realized I was caught up in a probable ‘charade’ that was perpetrated on me and I did realize my responsibility to the above blog.
    I have never had contact with any persons in any investement organization, vehicle or group, ever. Obviously, I am too trusting a person, of another person’s word. I have learned some very serious lessons and this is probably the best thing…that I learned. When I asked this question I handn’t realized it was a “blog”, I have never written a ‘blog’ til this question. I didn’t realize it was a blog until the Eagle Bullion Group Principal called me on March 8th and directed me back to your “important” website. Obviously, I am not computer or investor savvey; I’m just physically broken down middle aged guy, trying to get along and do the best he can for himself. I am not a person to take advantage of another, I am pleased to say this is the integrity of my character.
    I AM TRULY SORRY FOR HAVING OFFENDING YOU AND YOUR IMPORTANT WORK, HERE AT INVESTORSWATCHDOG.COM. I, GARY HAZEN, SINCERELY APOLOGIZE, FOR MY WRONG ACTIONS OF MY WRITTEN WORDS.
